What is a platební rozkaz?
A platební rozkaz (payment order) is a decision of an okresní soud (district court) on a money claim, issued without a hearing. It means that someone is asserting a claim against you, but it is not yet a judgment.
How to recognise a platební rozkaz
The header shows the name of the court and the číslo jednací (case number): for an elektronický platební rozkaz (electronic payment order) it starts with the letters EPR (for example EPR 83376/2026-5), for an ordinary one it contains the letter C. The heading reads "PLATEBNÍ ROZKAZ" or "ELEKTRONICKÝ PLATEBNÍ ROZKAZ". In the operative part the court orders you to pay the principal, interest and costs of proceedings within 15 days of service, or to file an odpor (objection) within the same period. The electronic order is signed by a senior court officer and carries a code for verifying its authenticity on the justice portal.
What a platební rozkaz is not
It is not a judgment. The court has not examined whether the claim is justified, only whether it follows from the claimant's assertions. Watch out for the heading "SMĚNEČNÝ" or "ŠEKOVÝ" platební rozkaz (bill of exchange or cheque payment order; the letters Cm in the číslo jednací): different rules apply there, the objections must state reasons and can be filed only once. We do not prepare a document for that case.
Your fifteen day deadline runs from the day of service, not from the date printed on the order. Details and a worked example are on the page Deadline for the odpor.
Your options
- Pay, if you consider the claim justified: within 15 days of service.
- File an odpor, if you disagree. No reasons are required.
- Do nothing: the order then takes on the effect of a final judgment and the claim can be enforced through enforcement proceedings.
