# Received a platební rozkaz?

Catius Documents explains what is in your platební rozkaz (payment order), how long your deadline really runs, and prepares your odpor (objection) if you decide to file one.

## What the platební rozkaz means for you

The platební rozkaz, today most often an elektronický platební rozkaz (electronic payment order; the letters EPR in the číslo jednací (case number)), is issued by an okresní soud (district court) without a hearing and without hearing you. The court has not examined whether the claim is justified; it relied only on the claimant's assertions. It is not a judgment, but if you do not file an odpor in time, it takes on the effect of a final judgment and the creditor can hand it to a bailiff.

> **Important: your fifteen day deadline starts on the day the platební rozkaz is served on you, not on the date printed on it.** If the order was delivered to your datová schránka (data box) and you did not log in, it counts as served on the tenth day after delivery. Write down the day of service.

## You do not need to give reasons for your odpor. But it must meet the formal requirements.

The law does not require you to give reasons (§ 174 odst. 3 o. s. ř.). Your odpor must correctly identify the court, the case number (číslo jednací) and the parties. It must be signed and filed on time, with the required number of copies. If the court has also ordered you to respond on the merits (§ 114b o. s. ř.), a separate deadline applies to that response. Catius Documents takes the details from your payment order and shows you both deadlines.

## The second deadline people forget

Together with the platební rozkaz, the court often orders you to file a written vyjádření ve věci samé (statement on the merits) after filing the odpor, within a set period of at least 30 days from the end of the odpor deadline (§ 114b o. s. ř.). If you do not file it, the court decides as if you had admitted the claim. We recognise this order in your platební rozkaz and show you the second deadline.
