When does the deadline for the odpor start?
The most common mistake: people go by the date on the platební rozkaz (payment order). What matters, however, is the day the order was served on you.
The fifteen day deadline starts on the day of service, not on the date printed on the order. There are usually several days between issue and service.
How to count the 15 days
The day of service is not counted; counting starts on the following day. Saturdays, Sundays and public holidays within the period do count. If the last day falls on a Saturday, Sunday or public holiday, the last day of the period is the next working day (§ 57 o. s. ř.). The deadline is met if the filing is handed to the post office or sent through a datová schránka (data box) on the last day of the period.
Which day is the day of service
- You accepted the letter in person: the day of receipt shown on the delivery slip. A platební rozkaz is served on the addressee personally; receipt by another person is not possible.
- The order arrived in your datová schránka and you logged in: the day you logged in.
- The order arrived in your datová schránka and you did not log in: the tenth day after delivery, even if you did not read the message. This ten day period is counted the same way: the day of delivery is not counted, and an end falling on a public holiday or weekend moves to the next working day.
Example: the order is delivered to the datová schránka on Friday 18 September 2026, with no login. The tenth day is Monday 28 September, a public holiday, so the order counts as served on Tuesday 29 September. The fifteenth day counted from 30 September is Wednesday 14 October 2026: the last day for the odpor (objection).
The second deadline: vyjádření ve věci samé
If the court, together with the order, required you to file a written vyjádření ve věci samé (statement on the merits) after filing the odpor (§ 114b o. s. ř.), that period, at least 30 days, runs from the end of the odpor deadline, not from the filing of the odpor. We recognise it in your order and show you that day too.
Has the deadline already passed?
The court rejects a late odpor. What remains is an application for relief from the missed deadline, filed together with the odpor within 15 days after the obstacle ceased, if you missed the deadline for an excusable reason. That depends on the individual case; we do not prepare this filing and recommend consulting a lawyer.
