# A Mahnbescheid or a Vollstreckungsbescheid has arrived?

## What a Mahnbescheid means for you

A Mahnbescheid is the start of the German court payment order procedure. It is not a judgment: the court has not checked whether the claim against you is justified, only that the application was filled in correctly.

> **Important: your two week deadline starts on the day the Mahnbescheid is served on you (Zustellung), not on the date printed on the document.** Write down the day the letter actually arrived.

## What a Vollstreckungsbescheid means for you

The Vollstreckungsbescheid is the second stage. Unlike the Mahnbescheid it is an enforceable title: money can already be taken on it, for example by an attachment of your bank account. It is issued when no Widerspruch was filed against the Mahnbescheid.

A Widerspruch no longer helps against it; the remedy is the Einspruch. Filed in the right form and in time, it moves the case to the competent court, where the claim is finally examined on its merits.

> **The deadline here is harder than for the Mahnbescheid: two weeks from service, and it is a Notfrist (Section 339(1) ZPO).** The Einspruch must have reached the court within it, not merely have been posted. Once it has run, the Vollstreckungsbescheid becomes final.
