# Received a fizetési meghagyás?

Catius Documents explains what the fizetési meghagyás (payment order) says, how long your deadline really is, and prepares the ellentmondás (objection) if you decide to object.

## What the fizetési meghagyás means for you

In Hungary the fizetési meghagyás is issued not by a court but by a közjegyző (notary). That is in order: the notary's procedure is equivalent to a court's. The notary has not examined the claim on its merits; the order itself says so. If you do not file an ellentmondás against the order within the deadline, it has the effect of a final judgment and enforcement can be requested against you.

> **Important: the 15-day deadline starts on the day of service, not on the date printed on the order.** If the letter came back marked "nem kereste" (not collected), it is deemed served on the fifth working day after the second delivery attempt. Write down the day of service.

## The ítélkezési szünet stops the deadline

Between 15 July and 20 August, and between 24 December and 1 January, a deadline counted in days does not run - this is the ítélkezési szünet (court recess). Someone who received the order on 10 July has a deadline that ends not on 27 July but on 31 August. Few people know this calculation; we do it for you.

## No reasons needed; witnesses give full evidential force

The ellentmondás does not have to give reasons: it is enough that it shows you disagree with the order. A typed ellentmondás has full evidential force only with the names, addresses and signatures of two witnesses; that is why the document always contains the witness section. The ellentmondás must be sent to the notary who issued the order, by registered mail; not to the chamber of notaries and not to the court.
