Frequently asked questions
Short answers to what we are asked most often.
Is this legal advice?
No. Catius Documents prepares the document from your details. We do not assess your case in law. To estimate your prospects, contact a lawyer.
How much does it cost?
Sprzeciw: 39 zł, zarzuty: 39 zł, including VAT, one-off, no subscription.
The deadline is shown free of charge before you pay.
Sprzeciw or zarzuty: which one do I need?
Read the title of the order. "W postępowaniu upominawczym" or "w elektronicznym postępowaniu upominawczym": sprzeciw. "W postępowaniu nakazowym": zarzuty.
Can I file it free of charge?
Yes. You can write the sprzeciw yourself, and no court fee is payable for it. For zarzuty the court fee is payable however they are written. Catius Documents is a paid, more convenient route, not an obligation.
When does my deadline start?
On the day of service, not on the printed date. Details on the page Deadline.
Do I have to give reasons?
For a sprzeciw, no (art. 480³ § 2 KPC). For zarzuty, yes: facts and evidence are required, and what you leave out cannot be added later (art. 493 § 2 KPC).
Can I dispute only part of the amount?
Yes. The order loses its force only in the part you challenge; the rest becomes final and enforceable.
Can I send it by e-mail?
No. Send it by post, file it in person at the court, or, for a sprzeciw in the EPU, through e-sad.gov.pl.
What happens if I do nothing?
The nakaz zapłaty has the effect of a final judgment, and the creditor can apply to a komornik (bailiff) for enforcement.
I only found out about the order from the komornik. What now?
This often happens in the EPU when the order went to an old address in the PESEL register. What remains is an application to restore the deadline, filed within one week together with the sprzeciw itself. We do not prepare that application; please consult a lawyer.
Do you prepare documents against a European order for payment?
No. For an order on form E a separate procedure with form F applies.
Can I withdraw from my order?
As a consumer you generally have the right to withdraw from the contract. Details on the page Withdrawal from the contract.
