Frequently asked questions
Short answers to the questions we hear most often.
Is this legal advice?
No. Catius Documents prepares a document based on the information you give us. Your individual case is not examined in law. For an assessment of your chances of success, contact a lawyer.
How much does the Einspruch cost?
9 EUR including VAT, one time, no subscription.
Can I file an Einspruch free of charge instead?
Yes. With a Bezirksgericht (district court) a form is enclosed with the Zahlungsbefehl (court payment order), and you can also make the Einspruch (objection) orally for the record on the Amtstag (the court's public office day). Catius Documents is a paid, convenient option, not a requirement.
When does my deadline start?
From service of the Zahlungsbefehl on you, not from the printed date; if the letter was deposited at the post office (Hinterlegung), from the first day of the collection period. See the page Zahlungsbefehl deadline for details.
14 days or four weeks?
You have 14 days for voluntary payment and four weeks for the Einspruch. For the Einspruch, the four weeks count.
The Geschäftszahl (case number) contains "Cg". What does that mean?
Then a Landesgericht (regional court) is handling the case. There the Einspruch needs the content of a statement of defence and a lawyer's signature. We prepare no document for that; go to a lawyer immediately. We still show you the deadline.
Can I file the Einspruch by e-mail?
No. Permitted are the post, JustizOnline (the Austrian justice portal), handing it in at the court in person, and the oral declaration on the Amtstag.
What happens if I do nothing at all?
After the four weeks have passed, the Zahlungsbefehl becomes final and enforceable. The claim can then be collected, for example by attachment of your wages or bank account.
What does an Einspruch cost me at the court?
No court fee is charged for the Einspruch itself. But the proceedings continue, and the losing party reimburses the other side's costs, including lawyer's fees. So consider whether you have objections on the merits.
Can I cancel my order?
As a consumer you generally have a right of withdrawal. See the page Right of withdrawal for details.
