# Zarzuty against the nakaz zapłaty

Zarzuty (objections) are the remedy against a nakaz zapłaty (payment order) issued "w postępowaniu nakazowym" (in the order-for-payment procedure). Unlike the sprzeciw, they cost a court fee and must state your facts and evidence.

## Deadline

> **You have one month from the day the order was served on you in the EU, including Poland (art. 480² § 2 pkt 3 KPC), not from the date printed on it.** Older sources sometimes still say two weeks; that is out of date. How to count is explained on the page [Deadline](/pl/en/termin/).

## Facts and evidence are required

In the zarzuty you must state the facts on which you base your objections and the evidence for each of them (art. 493 § 2 KPC). What you do not raise now, you cannot raise later (preclusion). We write the zarzuty from the facts you give us and list the evidence you name as attachments; we add no arguments of our own.

## Court fee

Zarzuty are subject to a court fee of three quarters of the full fee for the claim (art. 19 ust. 4 u.k.s.c.); if the order was issued against you as a consumer, at most 750 zł. The court rejects zarzuty that are not paid (art. 480³ § 3 KPC). Pay the fee by the last day of the period and attach the proof of payment. If you cannot afford it, you can file an application for exemption from court costs (wniosek o zwolnienie od kosztów sądowych) together with the zarzuty; we do not prepare that application.

## In full or in part

You can challenge the order in full or only in part, for example only the interest and fees. State exactly which amount you challenge.

## The order stays in force

Unlike a sprzeciw, zarzuty do not make the order lose its force. It remains a basis for securing the claim (art. 492 § 1 KPC); an order based on a bill of exchange or a cheque remains immediately enforceable, and the court may stay its enforcement on your application (art. 492 § 3 KPC). The court hears the case and ends it with a judgment that upholds the order in full or in part, or sets it aside and decides on the claim (art. 493 § 4 KPC).

## Ways of filing

- By post: handing the letter in at a Poczta Polska post office (or at the universal postal service in another EU country) counts as filing with the court (art. 165 § 2 KPC), even on the last day. Send it by registered post (list polecony) and keep the receipt.
- In person at the court's filing office (biuro podawcze): ask for a stamp on your own copy.
- Not by e-mail.

The zarzuty go to the court that issued the order, together with your evidence, the proof of payment of the fee and one copy (odpis) of the zarzuty with attachments for the claimant.

## No legal advice

Catius Documents does not assess your case in law and does not represent you. Because of preclusion, what you write in the zarzuty matters a great deal: for a large amount or if you are unsure, also consult a lawyer (adwokat or radca prawny).
