# Received a nakaz zapłaty?

Catius Documents explains what is in your nakaz zapłaty (payment order), how long your deadline really runs, and prepares your sprzeciw (objection) or zarzuty (objections) if you decide to file them.

## What the nakaz zapłaty means for you

A nakaz zapłaty is issued by a court on the creditor's application, at a closed sitting (posiedzenie niejawne), without hearing you. It is not a judgment (wyrok). But if you do not challenge it in time, it has the effect of a final judgment (art. 480² § 4 KPC) and the creditor can hand it to a komornik (bailiff).

> **Important: your deadline starts on the day the nakaz zapłaty is served on you, not on the date printed on it.** The day of service is on the potwierdzenie odbioru (the delivery slip that goes back to the court), not on the order itself. Write it down.

## First read the title: it decides which document you need

In Poland the kind of proceedings is printed in the title of the order. It decides the name of the remedy, the deadline and the cost.

- **"w postępowaniu upominawczym"** (ordinary reminder procedure, case number such as I Nc 123/26) or **"w elektronicznym postępowaniu upominawczym"** (EPU, the electronic procedure of the e-sąd in Lublin, case number such as VI Nc-e 1234567/26): you file a [sprzeciw](/pl/en/sprzeciw/). Two weeks, free of charge, no reasons required.
- **"w postępowaniu nakazowym"** (order-for-payment procedure based on documents): you file [zarzuty](/pl/en/zarzuty/). One month, a court fee is payable, and you must state your facts and evidence.

A European order for payment (Europejski nakaz zapłaty, issued on form E) follows different rules. We do not prepare a document for it.
