# Ellentmondás against a fizetési meghagyás

With the ellentmondás (objection) you tell the közjegyző (notary) that you disagree with the claim in whole or in part. No reasons are required.

## Deadline

## Form

There is no mandatory form for the ellentmondás. It is enough that the document makes clear that you disagree with the fizetési meghagyás (payment order) or part of it (Fmhtv. 28. §). No reasons are needed, no fee is payable, no lawyer is required.

A typed document needs the names, addresses and signatures of two witnesses to have full evidential force; that is why our document always contains the witness section. The witnesses can be neighbours, relatives, colleagues. A handwritten and signed ellentmondás needs no witnesses.

## To whom and how

- To the notary who issued the order, at the office address, **by registered mail**. Ordinary mail does not meet the deadline. Not to the chamber of notaries and not to the court: this is the most common and most expensive mistake.
- In person at the notary's office, during office hours.
- Orally before any notary, who records it in minutes.

Legal persons and other persons obliged to use the electronic procedure file an ellentmondás electronically, through the notaries' system; so does a legal representative acting for a party. Our paper letter is meant for private individuals acting alone.

## In whole or in part

You can dispute the whole claim or only part of it. With a partial ellentmondás, the undisputed part becomes final and enforceable. Amounts must be stated precisely; if in doubt, dispute the whole claim.

## What happens next

In the disputed part, the procedure turns into a lawsuit. Within 8 days the notary notifies the jogosult (claimant), who has 15 days to file the statement of claim and to top up the court fee; if they fail to do so, the court terminates the proceedings. After that you have nothing to do until the court contacts you. Whoever loses the lawsuit pays the other party's costs.
